Taking into account that in 2008, the market share in monetary terms under our estimation amounted to …% to … bln of Byelorussian roubles (Br) or … to $… mln. 29.05.2009 an agreement was signed with US embassy on the project “Climbing stairs of life”, is aimed at young people with limitied abilities due to impacted health who acquire professional education in educational establishments and their parents by means of introduction in Kharkiv and Kharkiv region of innovational training seminars on modern techniques of labour rehabilitation and adaptation in the society.

1. Предмет Договора
1.1 Поставщик обязуется поставить, а Покупатель принять и оплатить товар (далее – «Товар») на условиях настоящего Договора товар (далее – «Товар»). 2. Ассортимент, количество и цена Товара
2.1 Объем Товара (наименование, ассортимент, количество, цена за единицу и общая стоимость партии Товара) и срок отгрузки каждой конкретной партии Товара определяется Сторонами в подписываемых Сторонами Заявках-спецификациях (форма Заявки-спецификации приведена в Приложении №2 к настоящему Договору, являющееся неотъемлемой частью настоящего Договора). Любая из Заявок-спецификаций может быть согласована по факсу в соответствие с пунктом 12.2. настоящего Договора и является неотъемлемой частью настоящего Договора.
2.2 Цель приобретения Товара Покупателем - для оптовой торговли.
2.3 Страна происхождения Товара – Республика Польша.
3. Качество и характеристики (внешний вид) Товара
3.1. Качество поставляемого Товара должно соответствовать требованиям действующих в Российской Федерации стандартов, нормативно-технической документацией на Товар и условиям настоящего Договора.
3.2. Если Поставщик не передает или отказывается передать Покупателю относящиеся к Товару документы, которые он должен передать в соответствии законодательством Российской Федерации и/или настоящим Договором, Покупатель вправе назначить ему разумный срок для их передачи. В случае, когда документы, относящиеся к Товару, не переданы Поставщиком в указанный срок, Покупатель вправе отказаться от Товара.
3.3. Поставщик гарантирует качество Товара в течение всего срока его годности.
3.4. Остаточный срок годности Товара на дату поставки должен составлять не менее 85% (восемьдесят пять процентов) от установленного срока годности.
3.5. Поставщик определяет качественные характеристики упаковки (внешний вид) поставляемого Товара согласно макету Товара, представленному Покупателем в виде файла, созданного на платформе PC в форматах программ Adobe Illustrator или Adobe Photoshop ( *.ai, *.eps, *.psd, *.tif), а также определяет необходимость доработок указанного макета, в течение 2 (Двух) календарных дней с момента получения Поставщиком указанного макета от Покупателя, и в тот же срок предоставляет Покупателю на утверждение окончательный вариант макета. Распечатка файла, наложенная на конструкцию упаковки, должна содержать подпись лица, уполномоченного Поставщиком утверждать макет.
3.6. На основе окончательного варианта макета Поставщик изготавливает и предоставляет Покупателю эталонный образец Товара. Покупатель, в случае если изготовленный Поставщиком эталонный образец соответствует требованиям Покупателя, обязан подписать данный эталонный образец в течение трех рабочих дней с момента его получения. Утвержденный эталонный образец должен содержать подпись лица, уполномоченного Покупателем утверждать эталонный образец. В случае несоответствия эталонного образца требованиям Покупателя Поставщик обязан исправить выявленные недостатки в срок, указанный Покупателем. В случае выявления Покупателем повторного несоответствия представленного Поставщиком эталонного образца требованиям Покупателя Покупатель вправе отказаться от исполнения настоящего Договора.

In case the Buyer reveals another discrepancy of the control sample, provided by the Buyer, with the requirements of the Buyer, the Buyer has the right to withdraw from the present Contract.
